TERMS OF SALE:
Real Property: A deposit of $25,000.00 in cash, cashiers check or certified check will be required from the purchaser at the time and place of sale. The balance of the purchase price to be paid in cash at settlement, which shall occur on or before 45 days from the date of sale, time being of the essence. Otherwise, the deposit herewith required shall be forfeited and the property resold at the risk and cost of the defaulting purchaser, including attorney fees, deficiency in purchase price and all costs of resale. Interest to be paid on the unpaid purchase price at 10% per annum from date of sale to date of settlement. Costs of conveyancing, title examination, recording, transfer taxes, documentary stamps, and all other costs incident to settlement shall be borne by the purchaser. Taxes and all other public or governmental charges and/or assessments against the premises, which are or may be payable on an annual basis, are to be adjusted and apportioned as of the date of sale, and are to be assumed and paid thereafter by the purchaser. The purchaser agrees to waive any right of inspection for lead paint, asbestos and/or mold as provided under current Federal and State laws. In the event the Personal Representative cannot convey title for any reason, purchaser’s sole remedy is return of deposit.
